Night differential (NSD) is a premium pay for employees who work during nighttime hours. Under Article 86 of the Labor Code, work between 10:00 PM and 6:00 AM entitles employees to an additional 10% of their regular wage.

How Night Differential Works

Night Differential = Base Rate × 10% × Night Hours

The 10% premium is applied to whatever base rate applies (regular, OT, holiday)

Night Shift Hours

  • Coverage: 10:00 PM to 6:00 AM (8 hours maximum)
  • Rate: Additional 10% of regular hourly wage
  • Private Sector: 10% minimum by law
  • Government: 20% differential (different rules apply)

Who Is Covered?

Most private sector employees are entitled to night differential. However, some exemptions apply:

  • Managerial employees
  • Field personnel (those who work outside the employer's premises)
  • Domestic helpers (kasambahay)
  • Workers in establishments with fewer than 10 employees
  • Workers paid by result (piece rate)

Stacking with Other Premiums

Night differential stacks with other pay premiums. For example, if you work overtime during a holiday at night, you get:

  • Holiday premium (200%)
  • Overtime premium (+30% on top)
  • Night differential (+10% on the final rate)
Important: Some employers have higher NSD rates through company policy or collective bargaining agreements. The 10% is just the minimum required by law.
